High Court Judgment & Costs Award
After no less than 5 previous failed planning applications and appeals during the last two years, the High Court was today asked to rule that the Secretary of State's Planning Inspector was wrong to dismiss an appeal against an LBE Enforcement Notice which requires the removal of an overbearing and unneighbourly climbing frame structure erected without planning permission in a private garden on the Haymills Estate in Ealing.The High Court has now dismissed this latest appeal on all five grounds. The Court thus upholds the Decision of the Planning Inspector earlier this year, who refused to cancel the Enforcement Notice and grant planning permission. The High Court awarded costs in the amount of £6,000 against the appellant - reduced from over £7,000 claimed by the Secretary of State after the appellant, a company director, stated through her barrister, that she is unemployed.
