PCM Parking

Does anyone know the rules for receiving a parking ticket from these jokers??Is it obligatory to pay??Vehicle in question parked in a residents bay on South Acton Estate, last bank holiday monday.The other options were double yellow lines or individually marked house bays  with numbers).Im told either deny being driver or argue that you do NOT agree - as they word it, to their contract.You tube  gives some advice but im not sure how up to date or relevant as they talk about private carparks etc

I also find it irritating that just when you are struggling with your mobility you get a free bus pass.  People who can use public transport or cycle should be encouraged to use it.  An alternative is needed for later.

Yes agree with what you have written.There needs to be tolerance by the councils as parking restrictions are to severe.For example as I experience in Acton Gdns area. Double yellow lines on both sides of road completely unneccesary. Residents bays which are fair enough unless you are visiting & the house holder has no car to register & get permits,for permits.Surrounding roads all have restrictions, pretty much same as every where.In truth much as it annoys  me I do not know answer. In places like Ealing BDWY commuters would dump their cars all day & if I was resident not be happy.I feel therefore there needs to be some free allocated spaces, roads dlear of lines, cpz, bays etc etc

One of the reasons that the buses are slow is of course because of the amount of traffic. It is a bit of a Catch 22 situation.This is why pressure groups and feedback on the public transport systems are so important. There used to be a website called www.fixmystreet.com and you can still see some of what it did on the net.  It helped people with the same travel problems to get together to get them sorted out. Another problem is the paving over of front gardens to make car spaces.  This reduces the parking available to others in a street. And then when CPZs are introduced they reduce it even more as a lot of double lines on corners are included.  A CPZ just pushes the parking from one area to another until there is very little parking.  Some residents will have parking but tradesmen and carers then have great trouble in parking and the elderly may find that their families and friends can't visit easily.

Cars are a luxury & an evil necessity but extremely convenient. No waiting for a bus or train, or walking at either end.I always say councils & TFL cause pollution, in fact in the news this week there are calls for traffic lights to be phased to alleviate congestion, something which I regularly write to TFL about & they ignore.Correct new builds, tower blocks are on the increase. Acton Gdns typically has double yellow lines everywhere for no reason except revenue. A car was ticketed tonight, causing no obstruction purely a money making excercise.We need some parking spaces, let 1 side be free of restrictionns & motorists able to park.Fines are beyond the average persons income - normal middle class workers, a days wages in fact.Public transport is diabolical,, buses are slow, driver changes & a whole number of hold ups.The tube in my experience of the last few weeks, misinformation. Next train platform 8 goes to platform 9!!!Ticket machines wont take new money!!!Train stops at White City & goes no further etc etcMotorist pay a premium & are treated like dirt

Unfortunately it is a nationwide trend.  We can't all have cars.  There isn't space.  Just look at all the tower blocks that are being built without parking or enough parking.People don't like change but we are going to have to change.  We also have a lot of air pollution with the Government lobbying the EU to reduce the levels that they stipulate must not be exceeded; car companies cheating in order to market cars discharging excessive levels.We already have car share schemes.  We also need to make sure that we have good public transport going to to where most people need to go to. Not everybody is going to be able to get on their bike. In the United States there are a lot of problems because people move around and don't get the official letters so can't pay the fines in time and then they increase.  I guess this is now happening here.

Thankyou for taking time to offer opinions & advice.I paid, grudgingly also toying with not paying having trawled the web for advice also.However I was reluctant in case of bailiffs banging at the door.My absolute resentment is to the councils who make parking impossible & push people into a rut - SEE  R.I.P JEROME ROGERS post

Peter, private "enforcement" companies were regulated a few years ago resulting with clamping being outlawed (apart from DVLA and other government run departments)  - part of the shake up allows these private companies to ticket a car which is parked on private land, provided there are legitimate, clear signs. Gone are the days when you claim you were not the driver and could not prove who was. The registered keeper is now liable.  The process of appeal is much the same as council tickets - an independent adjudicator  - if you feel you were hard done by and have reasonable grounds to appeal then so do. If you lose and fail to pay then the process goes to county court.

Peter, you entered into a "contract" by parking in a residents bay.  Have you an argument against this e.g. the CPM signs were obscured by foliage, they were not at point of entry to car park, the wording on sign is not good English etc.  You will receive an increasing number of threatening letters, eventually from debt collectors and then from small claims at  County Court where the debt will have reached circa £250.  However if you have a good argument you have a good chance that the Judge will find in your favour not least because CPM are unlikely to turn up and will ask for their evidence to be heard in their absence.  Hope this helps.
