Acton High Street Shisha Lounge Gets Large Fine

A shisha lounge in Acton has been fined thousands of pounds after repeatedly breaching smoke-free legislation, following two council inspections that found customers smoking in an enclosed area. Aldiyar Ltd, which trades as Al Diyar on Acton High Street, and its director, Hussein Abdalkazim Hussein, pleaded guilty to the offences at Uxbridge Magistrates’ Court on 3 March.

The business was prosecuted for failing to prevent a person from smoking in a smoke-free location and for failing to display the legally required “no smoking” signage. The company was fined £3,000 and ordered to pay a £1,000 victim surcharge. Hussein, who is registered at the same address, received a separate £3,000 fine, was ordered to pay £2,223.70 in costs and a £1,000 victim surcharge, and now has a criminal record as a result of the offences.

Ealing Council officers first visited the premises in July 2024, when they observed customers smoking shisha inside an enclosed space, which is prohibited under national smoke-free laws. Despite being given advice and warnings, the business failed to take action, and a follow-up inspection in December 2024 found the same issues still occurring.

Councillor Kamaljit Nagpal, Ealing Council’s cabinet member for decent living incomes, said the case demonstrated the authority’s determination to enforce public health laws.

“Protecting public health and safety is a top priority for the council,” she said. “Every business has a duty to operate responsibly, and when they repeatedly ignore smoking laws, we will not hesitate to take the strongest possible action. Since 2023, 15 businesses in the borough have been taken to court for similar matters and ended up being fined a total of more than £70,000 for breaking the law.”

The council said it will continue to carry out inspections and take enforcement action where businesses fail to comply with smoke-free regulations.
